Terms of Service

These Terms of Service (Terms) govern your access to and use of yumigo.com, the YumiGo passenger and driver services, and related features and support channels (together, the Services).

YumiGo is operated by Antap Digital in Port Vila, Vanuatu (YumiGo, we, us or our).

By creating an account, requesting or accepting a trip, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. What YumiGo does

YumiGo is a technology platform that helps passengers find and arrange trips with independent taxi, private-car and bus drivers. YumiGo provides booking, fare-display, location, messaging and related platform functions.

YumiGo is not a transport operator, does not own the vehicles used for trips and does not employ drivers. A driver who accepts a trip provides the transport service directly to the passenger and is responsible for carrying out that trip safely and lawfully.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to create or use a YumiGo account.

Drivers must also hold every licence, permit, approval and insurance required to lawfully provide the relevant transport service in Vanuatu, and must satisfy YumiGo's current driver and vehicle requirements.

You may not use the Services if your account has been suspended or closed, or if applicable law prohibits you from doing so.

3. Accounts and verification

You must provide accurate, current and complete information and keep it up to date. Registration may require a Vanuatu mobile number and verification by an SMS one-time code.

You are responsible for activity on your account and for securing your phone and account access. You must not share verification codes, transfer an account, create an account for someone else without authority, or allow another person to provide trips using your driver account.

Tell us promptly at hello@yumigo.com if you suspect unauthorised access or if your account information is incorrect.

4. Passenger responsibilities

As a passenger, you agree to:

  • provide accurate pickup, destination and contact information;
  • be ready at the agreed pickup point and avoid unreasonable delay;
  • treat drivers, other passengers and vehicles respectfully;
  • comply with reasonable safety instructions and applicable law;
  • pay the fare shown and accepted when booking, subject to any change you expressly agree with the driver;
  • not damage or excessively soil a vehicle;
  • not carry unlawful, dangerous or prohibited items;
  • not threaten, harass, discriminate against or endanger a driver or another person; and
  • use an appropriate bus or vehicle option where the number of passengers or luggage requires it.

Passengers are responsible for supervising children and any person travelling under their care, and for using any legally required child restraint.

5. Driver responsibilities

Drivers use YumiGo as independent service providers and not as employees, workers, agents, partners or representatives of YumiGo. Drivers choose when to go online and may accept or decline trip requests, subject to these Terms and applicable law.

As a driver, you agree to:

  • maintain a valid driver's licence, vehicle registration, permits, insurance and any other approvals required for your service type;
  • provide genuine, accurate and current documents and promptly report any expiry, suspension, restriction or material change;
  • use only the approved vehicle and driver account shown to the passenger;
  • keep the vehicle safe, clean, roadworthy and suitable for the booked service;
  • obey road, transport, licensing, safety and non-discrimination laws;
  • review available trip and fare information before accepting a request;
  • travel safely, remain fit to drive, and never drive while impaired, dangerously fatigued or distracted;
  • provide the trip professionally and without unauthorised detours;
  • collect only the displayed or expressly agreed fare and provide any receipt required by law;
  • protect passenger information and use it only for the trip, safety or a lawful purpose;
  • report serious incidents, complaints or safety concerns promptly; and
  • cooperate reasonably with eligibility checks and legitimate safety investigations.

Drivers are responsible for their own operating costs, taxes, licences, insurance, vehicle, equipment and legal obligations.

6. Booking and the transport agreement

A passenger's request is an offer to book a trip. A transport agreement is formed directly between the passenger and driver when a driver accepts the request and the booking is confirmed through YumiGo.

We do not guarantee that a driver will be available, accept a request, arrive by a particular time, take a particular route or complete a trip. Availability and journey times can be affected by traffic, weather, road conditions, connectivity, demand and events outside YumiGo's control.

The passenger or driver may cancel where the Services permit. Repeated cancellations, no-shows or misuse may lead to warnings or account restrictions. Any cancellation fee will apply only if it is clearly disclosed before it becomes payable.

7. Fares and cash payment

YumiGo displays the fare before a passenger confirms a booking. Fares may be calculated using factors such as service type, route, distance and estimated time. YumiGo does not currently use surge pricing.

Passengers currently pay the driver directly in cash at the end of the trip. Drivers are responsible for collecting cash and providing change. YumiGo does not hold passenger funds, process the cash payment or guarantee that either party will perform a cash-payment obligation.

No additional amount may be charged unless it was clearly disclosed through the Services or expressly agreed by the passenger—for example, after the passenger changes the destination or requests an additional stop. A disagreement about a fare should be reported to hello@yumigo.com.

YumiGo may introduce commissions, platform fees, card payments or other payment methods in the future. Any applicable charge or updated payment term will be disclosed before it applies.

8. Location and communications

The Services may use device location to set pickup and destination points, identify nearby drivers, support routing, show a driver approaching and track an active trip. Accuracy can be affected by device settings, satellite coverage, mobile networks, maps and local conditions.

Passenger and driver contact or in-app messaging features are provided to coordinate bookings and address trip issues. You must not use them for harassment, spam, unsolicited marketing or any unrelated purpose.

In an emergency, contact the appropriate local emergency service. YumiGo is not an emergency service and cannot guarantee that support messages will be seen immediately.

9. Safety and conduct

Everyone using YumiGo must act lawfully and with respect. You must not:

  • use the Services for fraud, crime or any dangerous activity;
  • threaten, assault, harass, discriminate against or exploit another person;
  • carry weapons, illegal drugs or hazardous materials;
  • interfere with the Services, bypass security, scrape data, introduce malware or attempt unauthorised access;
  • make a false report, impersonate another person or submit fraudulent documents;
  • arrange a trip outside YumiGo to evade an applicable platform charge or safety control;
  • record another person unlawfully; or
  • use information obtained through YumiGo for an unrelated purpose.

YumiGo may review reports and relevant account, trip, location and communication records to protect users and investigate suspected breaches. We may contact emergency services or authorities where reasonably necessary to address a serious or immediate risk.

10. Driver review does not guarantee a trip

YumiGo may review driver identity, licence and vehicle information before approving or maintaining access. This review is intended to support eligibility and safety but is not a guarantee of a driver's conduct, ability, insurance, vehicle condition or legal compliance at every moment.

Passengers should confirm that the driver and vehicle match the details shown in YumiGo before entering the vehicle. Drivers should confirm the passenger or booking details before starting a trip.

11. Content and feedback

You retain ownership of material you submit, such as profile information, trip notes, messages, photos and incident evidence (User Content).

You give YumiGo a non-exclusive, worldwide, royalty-free licence to host, copy, process, display and share User Content only as reasonably necessary to operate, secure and improve the Services, comply with law and exercise our rights under these Terms.

You must have the right to provide User Content and must not submit anything unlawful, misleading, infringing, abusive or harmful.

If you provide ideas or feedback about YumiGo, we may use them without restriction or payment to you.

12. YumiGo's intellectual property

YumiGo and its licensors own the Services, software, branding, designs and related intellectual property. Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose.

You may not copy, sell, rent, reverse engineer, modify, distribute or create derivative works from the Services except where applicable law expressly allows it.

13. Third-party services

The Services may rely on or link to third-party maps, telecommunications, messaging or other services. Your use of a third-party service may be governed by that provider's terms and privacy policy. YumiGo is not responsible for a third-party service that it does not control.

14. Suspension and termination

You may stop using YumiGo at any time and may ask us to close your account.

We may restrict, suspend or close an account, remove access to a trip or feature, or require further verification where we reasonably believe this is necessary to:

  • address a safety concern or legal requirement;
  • investigate fraud, false documents, misuse or a breach of these Terms;
  • protect YumiGo, users or the public;
  • respond to prolonged inactivity; or
  • discontinue all or part of the Services.

Where appropriate, we will give notice and a reasonable opportunity to respond. We may act immediately where delay could create risk, enable fraud or breach the law.

Provisions that by their nature should continue after termination—including payment obligations, intellectual property, disclaimers, liability and dispute terms—will survive.

15. Service availability and disclaimers

We aim to provide a useful and reliable platform, but the Services may sometimes be unavailable, delayed or inaccurate. To the maximum extent permitted by law, the Services are provided on an "as available" basis without a guarantee of uninterrupted availability, a particular driver or passenger, or a particular result.

YumiGo does not control every act or omission of an independent driver, passenger or third party. Each user remains responsible for their own conduct and legal obligations.

Nothing in these Terms excludes any guarantee, condition, right or remedy that cannot lawfully be excluded.

16. Liability

To the maximum extent permitted by law, YumiGo is not liable for indirect, incidental, special or consequential loss, loss of opportunity, or loss arising from an event outside our reasonable control.

This does not limit liability that cannot lawfully be limited, including liability for fraud or other liability that applicable law requires us to accept. Nothing in these Terms removes the independent driver's responsibility for the transport service they provide or either party's responsibility for their own unlawful conduct.

You should report any accident, injury, alleged crime or serious safety incident promptly to the appropriate authorities and to YumiGo.

17. Indemnity

To the extent permitted by law, you agree to compensate YumiGo for reasonable losses, liabilities, claims and costs arising from your unlawful conduct, your material breach of these Terms, or—for drivers—your provision of transport services, except to the extent the loss was caused by YumiGo's own breach, negligence or unlawful conduct.

18. Changes to the Services or these Terms

We may change the Services and may update these Terms to reflect new features, business practices or legal requirements. We will post the updated Terms and revise the "Last updated" date.

If a change materially affects your rights or obligations, we will provide reasonable notice where practicable. Continuing to use the Services after the effective date of updated Terms means you accept them. If you do not agree, you must stop using the Services.

19. Governing law and disputes

These Terms are governed by the laws of Vanuatu. You and YumiGo agree to try to resolve a dispute informally first by contacting hello@yumigo.com.

If a dispute cannot be resolved, it may be brought before the courts of Vanuatu, subject to any mandatory right you may have under applicable law to bring a claim elsewhere.

20. General

If a provision of these Terms is found unenforceable, the remaining provisions will continue in effect. A delay in enforcing a right is not a waiver of that right. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms as part of a reorganisation, financing, sale or transfer of the Services.

These Terms, together with the Privacy Policy and any terms clearly disclosed for a specific feature, form the agreement between you and YumiGo concerning the Services.
